If the Trainee/User wants to cancel the planned courses due to special circumstances at least 24 hours before the course, a make-up course is planned. If canceled 12-24 hours before, 50% of the course fee is charged, and if canceled 0-12 hours before, the entire course fee is charged. The instructors who will teach the make-up lessons are determined by the institution.
Except for force majeure (flood, fire, earthquake etc.), the contract cannot be terminated unilaterally by the trainee. In case the contract is terminated unilaterally by the trainee without force majeure, the trainee accepts, declares and undertakes to pay the entire contract price in advance. In the event that the reasons for termination are determined by the institution, when 30% of the cost of the remaining part, which is not serviced, is paid by the student, the student’s contract is terminated and the remaining fee is returned to the trainee.
CHANGıng OR TERMINATıng OUR SERVICES
We are constantly changing and improving our services. We may add or remove functionality, features or requirements, and we may suspend (to the extent permitted by applicable law) or discontinue some of our Services. Accordingly, Elite University Prep & Elite Academy may terminate your use of any Service for any reason.
We may not be able to offer the Services to certain regions or countries for a variety of reasons, including applicable export control requirements or internet access restrictions and government restrictions. None of Elite University Prep & Elite Academy, their Content Providers and instructors, contributors, sponsors, and other business partners, and their employees, contractors, and other representatives (“Elite University Prep & Elite Academy Parties”) will not be liable for any such action.
TERMINATION OF THE PROGRAM and courses
You guarantee that you are not located or normally resident in any country subject to applicable TURKISH laws and regulations that prevent Elite University Prep & Elite Academy from providing you with access to the Services. Your location is determined by your physical location. The use of a virtual private network service, IP routing services or other similar services to circumvent these laws is strictly prohibited.
You guarantee that your name is not listed under any government prohibition, denied, unverified party, sanctions, embargo or exclusion list or export-controlled associated restricted party list (collectively, the “Sanction Lists”). If you are placed on any Sanction List, you will immediately cease your use of the Services. You further guarantee that you will not export, re-export or transfer the Services to any Enforcement Listed entity or use the Services in violation of applicable law.
Notwithstanding anything to the contrary in these Terms, Elite University Prep & Elite Academy may immediately terminate other obligations to you if you breach the obligations in this section.
COMPENSATION
You agree to indemnify, defend and hold harmless the Elite University Prep & Elite Academy Parties from any claims, liabilities, costs and damages (to the extent attributable to you under applicable law), including reasonable attorneys’ fees and expenses, incurred by any third party.
APPLICABLE LAW AND JURISDICTION
Except as noted below, the Services are provided by Elite University Prep & Elite Academy, Inc. in Turkey. You agree that these Terms will be governed by the Istanbul Courts, excluding conflict of laws provisions.
TRANSFER
The trainee cannot transfer his right to receive training arising from this contract to third parties. In this case, the liability for the debts arising from this contract continues.
suspendıng the course
Training programs are initiated by the course due to the confidence in the continuation of this contract and the Trainee is expected to continue the service provided. For the aforementioned reason, suspending the course cannot be requested after a course has started.
It is possible to suspend between courses, and in any case, a written application must be made to start education within 3 months. Failure to start the course program up to 30 days from the date of application cannot be considered as defective performance by the Trainee. The trainee who has suspended his right to receive education is obliged to continue to pay the above-mentioned fee in due time.
